1. General Provisions
This Policy explains what personal data AUTOBID receives, why it uses it, to whom it may disclose it, how long it stores it, and what rights the User has. This Policy applies to website visitors, registered Users, Sellers, Bidders, persons purchasing tickets or contacting support, as well as other persons whose data has been lawfully provided to AUTOBID. AUTOBID processes only the data necessary for operating the Service, conducting auctions, ensuring security, performing the agreement, and complying with legal requirements.
2. What Data AUTOBID Processes
The specific types of data depend on the functions a person uses.
2.1. Account Data
AUTOBID may process: • first and last name; • phone number; • email address; • User identifier; • selected language; • account and notification settings; • contact verification status; • account status and restrictions; • login history and significant changes to settings.
2.2. Vehicle Data
When creating a vehicle card and Lot, AUTOBID may process: • make, model, year of manufacture, and technical specifications; • mileage; • description of condition, known damage, and defects; • photographs; • document images provided for by the interface; • location to the extent necessary for the Lot; • information about the right to offer the vehicle; • moderation results. Vehicle information may constitute personal data when combined with information about a specific person.
2.3. Lot and Auction Data
AUTOBID may process: • Lot number and status; • information about the Seller and Bidders; • bid amounts, sequence, and server time; • current price and reserve price; • whether the reserve price has been met; • auction extension, suspension, or cancellation events; • auction result and information about the Final Leader; • confirmations related to participation and contact disclosure; • an event log necessary for dispute resolution.
2.4. Tickets and Payments
AUTOBID may process: • ticket type, quantity, and status; • selected package, price, amount, and currency; • order or payment date and status; • order, payment, and payment provider identifiers; • information about ticket allocation, reservation, deduction, and restoration; • information about monetary refunds. AUTOBID generally does not receive or store the full bank card number, CVV/CVC, PIN, or other secret payment instrument data.
2.5. Support and Appeals
AUTOBID may store: • the subject and content of a request; • correspondence; • attached files; • related Lot, order, and other object numbers; • information about the review and decision made; • technical information necessary to resolve the issue. Do not send passwords, verification codes, full bank card details, or other information unnecessary for reviewing the request through support.
2.6. Technical Data
When using AUTOBID, the following may be processed automatically: • IP address; • date and time of the request; • information about the browser, device, and operating system; • selected language; • session identifier and status; • necessary cookies; • error logs; • login, logout, and security events; • employee actions in the administrative area. This data is used to operate the Service, protect accounts, and investigate technical or security incidents.
3. Sources of Data
Personal data may be received: • directly from the User; • from the User’s browser, device, and actions in AUTOBID; • from another User, where necessary for interaction provided for by the Public Offer; • from the payment provider; • from authorized employees during moderation and support; • from competent authorities in cases provided for by law. AUTOBID must not use information known to have been obtained unlawfully.
4. Purposes of Data Use
AUTOBID may use data for: • registration, authorization, and account protection; • creating and storing a private vehicle card; • moderating and publishing a Lot; • checking the completeness, format, and internal consistency of information entered by the User, and moderating uploaded materials; • conducting auctions and accepting bids; • determining and confirming the result; • accounting for tickets; • processing orders, payments, and refunds; • disclosing the Seller’s and Final Leader’s contacts; • sending necessary service notifications; • responding to requests and appeals; • preventing fraud and other violations; • ensuring the reliability and security of the Service; • complying with legal requirements; • establishing, exercising, or defending legal claims. AUTOBID does not use personal data for advertising or marketing communications without a separate lawful basis.
5. Legal Bases for Processing
Depending on the specific operation, the legal basis may be: • performance of an agreement with the User; • steps taken at the User’s request before entering into an agreement; • the User’s consent; • compliance with a legal obligation of the Operator; • protection of AUTOBID’s or other persons’ legitimate interests, where permitted by law and where this does not override the User’s prevailing rights; • another basis provided for by applicable law. Where processing is based on consent, the User may withdraw it. Withdrawal applies prospectively and does not render unlawful processing carried out before the withdrawal. If another lawful basis exists after withdrawal, the necessary data may continue to be processed within the scope of that basis.
6. Information Visible in a Published Lot
After publication, only information intended for the public card may become publicly available, for example: • photographs of the vehicle; • make, model, year, and specifications; • description of condition, known damage, and defects; • location indicated in the interface; • auction schedule and status; • current price; • anonymized bid history; • Lot number. The contents of the public card are determined by the settings of the specific Lot and the AUTOBID interface. The following are not made public: • the Seller’s or Bidder’s name, email, and phone number; • document images; • hidden reserve price; • private drafts; • internal moderation results and employee comments; • payment and technical account data. The User must not place other people’s contacts, documents, or other personal data that are not necessary for the Lot in photographs or descriptions. AUTOBID may hide or delete such information.
7. Contact Disclosure After the Auction
Before submitting a Lot, the Seller separately confirms the disclosure of their contacts to the future Final Leader. Before the first accepted bid in a specific Lot, the Bidder separately confirms the disclosure of their contacts to the Seller if they become the Final Leader. After the Final Leader has been successfully determined, AUTOBID discloses only to this pair: • first and last name; • email address; • phone number. Contacts do not become publicly available and are not disclosed to other Bidders. The party receiving the contacts must use them only to communicate regarding the relevant potential transaction and may not publish, sell, or use them for unlawful spam, harassment, or fraud.
8. Data of Other Persons
Photographs, documents, descriptions, and requests may contain data of other individuals. The User must: • have a lawful basis for transferring such data; • not transfer unnecessary information; • conceal data that is not needed for verification or conducting the auction; • not publish other people’s passwords, access codes, or payment details. AUTOBID may hide, restrict, or delete information that is not required for operating the Service or that was provided without a sufficient legal basis.
9. To Whom Data May Be Disclosed
Access to data is granted only to the extent necessary for the relevant purpose. Recipients may include: • authorized AUTOBID employees; • hosting and file-storage providers; • providers of service email or SMS notifications; • payment providers; • providers of Service protection and technical maintenance; • legal, accounting, and other professional advisers where necessary; • the Seller and Final Leader — only to the extent described in Section 7; • courts, law enforcement, tax, and other competent authorities where disclosure is required by law. A provider processing data on AUTOBID’s instructions must receive only the access necessary and comply with applicable confidentiality and security requirements. AUTOBID does not sell Users’ personal data.
10. Payment Data
Payment for tickets may be processed by an independent payment provider. It receives payment instrument data directly and processes it under its privacy policy and legal obligations. AUTOBID receives from the provider only the information necessary to account for the order, allocate tickets, verify payment status, and issue refunds. AUTOBID does not accept payment for the vehicle itself through the Platform. Any settlements between the Seller and the Final Leader take place outside AUTOBID.
11. International Data Transfers
If a provider necessary for AUTOBID’s operation processes data outside the User’s country of residence, the transfer is carried out only where a legal basis and safeguards provided for by applicable law exist. Before such transfer begins, AUTOBID must identify the actual recipient and the necessary conditions in the current version of the Policy or provide the relevant information by another available means.
12. Retention Period
AUTOBID stores data no longer than necessary for the purposes of processing. When determining the retention period, the following are taken into account: • duration of the account’s existence; • status of the vehicle card, Lot, and auction; • need to confirm bids and results; • status of tickets, orders, payments, and refunds; • requirements of accounting, tax, and other laws; • period during which a dispute may arise; • need to ensure security and prevent fraud. After an account is closed, some data may be retained where necessary to comply with the law, confirm transactions, resolve a dispute, or defend legal claims. After the necessary period ends, data is deleted, destroyed, or anonymized unless further retention is required by law. Deleting a public Lot or closing an account does not mean that related financial records, consents, and the auction log are deleted immediately.
13. Security
AUTOBID applies reasonable technical and organizational measures, including: • access-rights management; • protection of authorization and sessions; • restriction of employee access; • logging of administrative actions; • inspection of uploaded files; • separation of public and private materials; • backups; • monitoring of suspicious activity; • software updates. No information system can guarantee absolute security. The User must also protect their password, verification codes, and devices and must not disclose them to third parties.
14. Cookies
AUTOBID uses necessary cookies and similar technologies for: • authorization and maintaining the session; • protecting the account and requests; • saving the selected language; • operating the website’s core functions. Disabling necessary cookies may make login and some functions unavailable. If optional analytics or advertising technologies are added to AUTOBID, the Policy and the User-choice mechanism must be updated before they are used in cases required by law.
15. Automated Operations
AUTOBID automatically applies the terms of the Public Offer, the parameters of the specific Lot, and technical restrictions, including checking bid eligibility, server time, minimum increment, and extension conditions. The Service may also automatically detect technical errors and suspicious activity. A bid may be rejected if it does not comply with the Lot’s terms or was submitted after the auction ended. Such operations do not confirm ownership rights, the technical condition of the vehicle, or conclude a sale and purchase agreement between the parties. If a restriction requires review, the User may contact the “Support and Appeals” section.
16. User Rights
Depending on applicable law, the User has the right to: • know the sources and purposes of collection of their data; • receive information about processing; • access the data and obtain a copy; • request correction of inaccurate data; • request modification or deletion of data in cases provided for by law; • object to certain processing; • withdraw previously provided consent; • receive information about recipients to the extent provided for by law; • protect themselves against unlawful processing; • lodge a complaint with the Ukrainian Parliament Commissioner for Human Rights or a court; • exercise other rights granted by applicable law. Some requests may be restricted if retaining the data is necessary to comply with the law, protect other persons, resolve a dispute, confirm a transaction, or prevent fraud.
17. How to Submit a Request
A personal-data request may be sent: • to privacy@autobid.example; • through the “Support and Appeals” section; • to the Operator’s postal address. The request should describe the required action and provide information that allows the relevant account or transaction to be located. Before providing a copy or fulfilling a sensitive request, AUTOBID may reasonably verify the identity and authority of the applicant. A response is provided within the time limits established by applicable law. The User may also request closure of the account. Data that must be retained by law or to defend claims may remain under restricted access until the relevant period ends.
18. Children’s Data
AUTOBID’s commercial functions are intended for adult Users with legal capacity, unless applicable law provides otherwise. AUTOBID does not knowingly request data from minors for independent participation in commercial auctions. Upon discovering such an account, AUTOBID may restrict it and delete data for which there is no lawful basis for retention.
19. Changes to the Policy
AUTOBID may update the Policy when the Service’s functions, the types of data processed, or the law change. The current version is published with a new date. If a change materially affects the User’s rights or requires new consent, AUTOBID provides notice or requests new consent in cases provided for by law.
